What do the 2023 regulations mean for healthcare procurement?

The Provider Selection Regime (PSR) Regulations 2023, officially enacted on 1 January 2024, mark a significant shift in how healthcare services are procured in the NHS and local government. These changes stem from the 2022 Act, and they’ve been widely welcomed by stakeholders across the healthcare sector.

The new regulations are designed to replace the old procurement rules, which were previously governed by The Public Contracts Regulations 2015 and the procurement, patient choice, and competition regulations (commonly referred to as monitor guidance). The PSR offers a more flexible approach, giving relevant authorities greater autonomy in selecting providers without any preferred options. This flexibility is particularly beneficial in adopting stable partnerships and delivering integrated care, as it allows for competitive tendering where it adds value, while also permitting other procurement routes that may be more proportionate.

Under this new regime, authorities must still prioritise value for money, ensuring that their decision-making processes remain transparent, fair, and proportionate. Established under section 12ZB of the 2006 Act (as amended), the PSR is a crucial tool for adapting to the evolving landscape of healthcare procurement.
